Abstract

What explains an increase in sexual violence prosecutions brought before international criminal tribunals? I investigate this question by examining three cases: The International Military Tribunal of Nuremberg, the International Criminal Tribunal of the Former Yugoslavia, and the Extraordinary Chambers in the Courts of Cambodia. There are international norms present within these cases. One of these norms treats sexual violence as a natural consequence of war, while the other norm acknowledges that this violent behavior is wrong and demands accountability. I identify a prioritization of the second of these norms and argue this has impacted the global response to wartime sexual violence.
